By accessing or using the QNeesh, LLC corporate website at qneesh.com (the "Website"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree, do not use the Website.
These Terms govern your use of the Website only. Our products and services (such as the Trivmo dating app) are governed by their own separate terms and conditions, available on each product's website or within the application.

QNeesh, LLC develops and operates consumer applications, including Trivmo. Each product has its own terms of service and privacy policy that govern your use of that product. These Website Terms do not apply to or govern your use of any QNeesh product or service. Please refer to the specific product's terms before using it.

WE DO NOT WARRANT THAT THE WEBSITE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, QNEESH, LLC AND ITS OFFICERS, DIRECTORS, MEMBERS, EMPLOYEES, AGENTS, AFFILIATES, SUCCESSORS, AND ASSIGNS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE WEBSITE, REGARDLESS OF THE THEORY OF LIABILITY.
OUR AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE WEBSITE SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS (USD $100).
SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR CERTAIN DAMAGES. IN SUCH JURISDICTIONS, OUR LIABILITY IS LIMITED TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.
You agree to indemnify, defend, and hold harmless QNeesh, LLC and its officers, directors, members, employees, agents, affiliates, successors, and assigns from and against any and all claims, demands, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the Website; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; or (d) your violation of any third party's rights.
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles.
Any disputes arising out of or relating to these Terms or the Website shall be resolved exclusively in the state and federal courts located in the State of Delaware, and you consent to the personal jurisdiction of such courts.
For users in the European Union, European Economic Area, or United Kingdom: Nothing in these Terms limits your rights under mandatory consumer protection laws of your country of residence. You may bring legal proceedings in the courts of your country of residence.
Before initiating any formal legal proceeding, you agree to first contact us at legal@qneesh.com and attempt to resolve the dispute informally for at least thirty (30) days.
QNeesh, LLC shall not be liable for any delay or failure in performance resulting from causes beyond our reasonable control, including but not limited to: natural disasters, pandemics, war, terrorism, government actions, labor disputes, power failures, internet or telecommunications failures, or cyberattacks.
We may update these Terms from time to time. When we make changes, we will update the "Last updated" date at the top of this page. Your continued use of the Website after changes take effect constitutes acceptance of the updated Terms. If you do not agree, you should stop using the Website.
If any provision of these Terms is held to be invalid, illegal, or unenforceable, that provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, severed from these Terms. The remaining provisions shall continue in full force and effect.
The failure of QNeesh, LLC to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Any waiver shall be effective only if in writing and signed by QNeesh, LLC.
These Terms, together with the Privacy Policy, constitute the entire agreement between you and QNeesh, LLC with respect to the Website and supersede all prior or contemporaneous agreements, understandings, representations, and warranties.
You may not assign or transfer these Terms without our prior written consent. QNeesh, LLC may assign these Terms without restriction, including in connection with a merger, acquisition, or sale of assets.
